O juiz Barnes apresentou esta semana as conclusões do inquérito sobre o cerco ao Cafe Lindt, em dezembro de 2014.
Ao final de muitas horas de cerco policial ao Cafe Lindt, no centro da cidade, quando a polícia forçou a sua entrada no local, morreram o gerente do estabelecimento, Tori Johnson, com um tiro do atacante, a advogada Katrina Dawson, com balas da polícia e Man Haron Monis, o atacante armado que fez reféns dentro do café.
A brasileira Márcia Mikhael estava no local e sobreviveu ao cerco, mas foi baleada na perna e teve que passar por algumas cirurgias.
O juiz Michael Barnes disse que o terror sofrido pelos reféns poderia ser classificado como tortura.
Ele exonerou a ação polilicial, reconheceu o peso da responsabilidade sobre o comando da polícia.
Ele disse que os policiais teriam que viver com o resultado das decisões que tomaram - decisões que, segundo o juiz, os críticos da ação policial nunca precisarão tomar.
"I cannot stress too heavily that the deaths and injuries that occurred as a result of the siege were not the fault of the police.
All of the blame for those rests on the shoulders of Man Monis. He created the intensely dangerous situation. He maliciously executed Tori Johnson. He barricaded himself into a corner of the cafe and his actions forced police to enter the cafe in circumstances where the risk of hostages being wounded or killed was very high.
Monis deserves to be the sole focus of our denounciation and condemnation. "
O ministro federal da Justiça, Michael Keenan, disse à Sky News que alguns dos problemas que vieram à tona no dia do cerco já eram conhecidos do governo, como o passado problemático do atacante Man Haron Monis.
"We've already had our own review into the Martin Place siege, which was conducted by the Commonwealth government in conjunction with the New South Wales government, and the findings of that review did make for pretty horrible reading because what it showed is that there was a whole series of failures over many, many years to deal with Man Monis - the individual who ultimately went on to conduct that siege."
